years ago and the environmental nightmare it was but at least this tanker was empty. >> reporter: yes, it was. that tanker just unloaded its cargo of fuel in martinez and then anchored off south of the bay bridge in the bay to wait for possible new cargo. none of it happened so it decided to leave empty and they left and hit the bay bridge and now the coast guard is saying tonight, preliminary findings show, it was human error. when the tanker hit tower 6 the fog was thick and visibility a quarter mile. engineers found no significant damage and the bridge never closed down >> basically a scrape, for the bay bridge it didn't touch the actual structure itself. >> reporter: coast guard video shows some damage to the star board or right side of the double hulled tanker >> there is not a gash there is i would characterize a crushing

of the hull where it aligned with the frienderring system. >> reporter: that acts like a bumper around the towers and anchor of the bridge and took the brunt of today's run in, 40 feet will be replaced. >> damage in the way it was supposed to protected the bridge. >> reporter: frienders protected the bridge five years ago -- frienders protected the bridge five years ago when 53,000 gallons of oil was spilled into the bay. the pilot went to prison for negligence allowing the tanker to leave in fog conditions so extreme the bow of the vessel could not be seen from the bridge. now today's pilot is experienced with no incidents reported in the 7 years he has been a pilot here in san francisco bay area. the bar pilot's association said he did pass his alcohol test but drug tests are pending. >> what mr. happen to the tanker? >> reporter: it remains anchored off treasure island

nose down in a mud pond. the pilot, and passenger walked away uninjured but the plane had damage, sheriff's deputy on site said the pilot may have been going too fast when he attempted to land. the man accused of killing 7 people in oakland last year, has been found mentally incompetent t 43-year-old was back in -- the 43-year-old was back in court for testimony on his mental state. one of two court appointed psychiatrists found him to be suffering paranoid schizophrenia. the horror of what happened in colorado spilled out in court today. the accused gunman, sat motionless through it all. >> reporter: he was let in with hair cut short and he has a beard. the first witness was officer

jason, he spotted him spotted in full body armor realizing he was not a cop he drew his gun and arrested him. he was very relaxed he said there was no normal emotional response he seemed very detached from it all. officer just inwas among the first in the theatre. i almost fell down he said because of the blood. huge, large amounts of blood. with no ambulances yet at the scene, he made four trips in his squad car taking injured to hospitals, one of them was caleb medley who stopped breathing. i screamed at him he said, don't die on me. don't die on me. medley survived. he said of the inside of his car there was so much blood it was sloshing. 6-year-old veronica sullivan was found by specialist sergeant gerald he was close to tears i checked for a pulse she

criminal record the four officers put on administrative leave are back to full duty. 1985 a young girl was murdered and left in a south way dumpster. len ramirez shows us how one of the victim's final acts helped catch her killer. >> reporter: it has been 28 years since a passer by discovered the body in the dumpster behind this mountain view safeway. her final struggle and the scratches she inflicted on her attacker are pointing the finger of blame at daniel garcia. he was arrested and formerly charged with her 1985 murder. >> anyone out there, who committed a heinous crime whether it was 1965, 75, or last year, we don't forget

about the victims. every day that is what we come to work for. >> reporter: there were no witnesses little evidence was left at the scene behind the bailey park safeway on north shore line but police did clip and preserve the victim's finger nails. recent advances unavailable in 1985, linked tiny skin fragments to garcia who is already in the data base from a non-related case. he had been previously linked to her and a person of interest in the murder case but they couldn't make an arrest until the dna match was made. >> if the crime lab took a look at an evidence item 10 years ago or even 5 years ago and wasn't able to link it to someone today they could redo that same analysis and link it to someone in the system and help make an arrest. >> reporter: this was a joint investigation by santa clara county cold case unit and the

fast enough. nationally the standard time is within 6 minutes, 90% of the time. san jose's goal, 8 minute80% of the time. kiet do shows they are not meeting that goal. >> reporter: they knew in their gut response times were going from bad to worse. after all the city laid off 50 firefighters and a half dozen or so engines went out of service. despite that year after year reports said response times did not get longer. so the report was giving a lazar picture. >> it was a higher performance than we were experiencing. >> reporter: the problem a computer glitch that has since been fixed. san jose's response time of 8 minutes one of the slowest in the country. >> i think everyone understands

that morning commute until 9:00 a.m., east bay, south bay, inland valley, leave a couple minutes early coming up tomorrow. we will soon be directly under a big area of high pressure that causes all the pollutants to get trapped in the lowest level of the atmosphere that is why air quality will not be good. highs 60s tomorrow will be the mildest day of the week as that high pressure dome is over northern california and the bay area. quickly it will move out by wednesday we will have a cold front arrive. a couple showers. later on this week, a big deal with cold air low pressure will slide down from the gulf of alaska the snow level will likely drop to 1500 feet. not a tonne of moisture scattered showers here and there but higher hills, you likely will see snow showers there coming up thursday and friday, highs barely into the 50s. enjoy the 60s tomorrow east bay and south bay.

een red light cameras will be coming to one of san francisco's most dangerous intersections. market and octave yeah street. it is a hazardous area because of cars making illegal right turns on to the central freeway. you will be happy to know feeding the meter is getting easier in san francisco. oh, joy. the popular pay by phone program is being expanded. customers can use their cell phones to pay the meeter and get a reminder when it is about to expire. meters along the embarcadero are not part of the program because they fall under the port of san francisco, jurisdiction. we have smart cars, smart phones now there is a smart fork. the happy fork tracks how fast you eat and how many bites you take. when you are eating too fast it lets you know to slow down with
